Hi would like to have your input on this as I found out that she lied about me being the father of the second child but I'm also have doubts that the first one is mine what are my rights ????


Formal agreement regarding maintenance and concealment of paternity Between Jack and jill

Jill acknowledges and is in agreement with the following:
• Jack has supported her well being prior and after the birth of Barbie born on x XXXXX 2007 (their daughter).
• That she has been receiving maintenance on a weekly basis from Jack since the birth of their daughter (as stated above).
• That she has concealed the true Identity of the biological father and therefore misleadingly the accused Jack of being the father to her second child Ken born on the xxxxx 2009.
In a verbal agreement and now in this document Jill acknowledges and is in agreement with the following:
• A paternity test taken by the biological father and mother proves that Jack is not the father of the second child born to Jill.
• That she would pay back the debt incurred for the first two months by herself and Ken in the sum of R2300.00.
• From the R150.00 maintenance due to Barbie , Jack will deduct an amount of R100.00 till the sum of R2300 is paid up in full. All future payments will be signed for upon receipt as sign and dated below.
• That he has custody to see Barbie every second weekend provided the above agreed maintenance is paid, should agreement not be held in terms of visitation, the above mentioned maintenance will be withdrawn.
Jill has agreed to give Jack copies of the following:
• To give Jack a copy of the paternity test results.
• Proof that his name does not appear on the birth certificate or any or such legal or binding documents.
• Should the above not be agreed upon the matter is to be taken to court for a Judge to make a final decision.

It must have been a shock to realise you're not the second child's father. I hope everything settles down and you manage to keep up a good relationship with your daughter.

Hi Jack
You are correct in wanting to place a formal agreement in effect. Although your intent is correct the manner in which you are writing this agreement is going to place you in hot water very quickly. First off maintenance cannot determine contact and contact cannot be withdrawn or withheld if maintenance is not paid. In a nut shell maintenance does not equal contact and vice versa.

With regards to the paternity of your children and your legal rights we would need more detail to advise you correctly on how to proceed further.

We would strongly suggest that you and Jill mediate a settlement around all the matters and it need not cost you the earth to resolve this, and have a binding agreement made an order of court. If Jill is not prepared to seek reason on this matter then please contact Fathers 4 Justice so we can point you in the right direction of a cost effective lawyer to help you resolve this matter.

Hi,

Thank you for the reply I just need her to acknolwege that I was there and was indeed paying since before the birth of my daughter. I always had a feeling that Barbie might not be mine as well so I am going to purchase a home testing kit over the weekend .
