Can anyone advise me how you reverse an adoption order? It was finalized late 2009, early 2010... not sure when, as the social workers do not bother to let you know how it is progressing.

The children's act state a couple of very specific circumstances under which an adoption can be reversed. Do you know what those are and that one of them applies to your case? Then I would suggest that you approach the children's court directly and if that doesn't work, a lawyer who specialises in family law.

I am trying to look it up on the internet. There is a lot of information for other countries but few on South Africa.
I am aware that you can apply for a rescission of an adoption but not sure how long you have to do this and the grounds on which you can do this. This is a step-parent adoption.

as soon as the bio-mother sign consent a 60 day period kick in where either the bio-mom or the adoptive mom can change their minds about the adoption. once the 60 days are over and it is finalized in the Children’s court it is done. if you want to fight this you need to go to the Childrens Court for more accurate details or like Maria said speak to a lawyer who specialises in Family Law / adoption law.

You ahve exactly 2 years in which to change your mind. But mind you they don't just let you reverse the adoption, you have to apply for it and the court will decide so a very good reason is necessary.

Adoption goes through the magristrates court, so just go to the same court where the adoption was done and ASAP.

The rescission on an adoption order (repeal) may be made to the Children's Court and you must apply within six months of becoming aware of the adoption order, but no later than two years after the order was made.

The 60 days that the previous writer referred to is actually the time that the birth parent has to change their mind and ask for the return of the child.
